What to expect
  • Mhisper is for thinking, capturing, and (when those features land) sharing thoughts in good faith.
  • Free use is genuinely free. Paid tiers are clearly described and cancellable any time.
  • You own everything you put into Mhisper. We hold a narrow licence to display, sync, and process it for you — nothing else.
  • We don't use your content to train AI models. If a future feature involves an AI provider, it will be opt-in.
  • We provide the service as-is, with reasonable care — please keep an exported memory file of anything important.
  • Disputes are resolved under Australian law; Australian Consumer Law guarantees still apply where relevant.

Who you're contracting with

These Terms are an agreement between you and Mhisper (“Mhisper”, “we”, “us”, “our”), based in Australia.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Mhisper is a note-taking app — a canvas of floating bubbles in which you can write, dictate, organise, and share thoughts. We provide the Service through the website at mhisper.app, the Mhisper iOS app, and the Mhisper Android app.

We may add, change, or remove features at any time. We will give reasonable notice for changes that materially reduce functionality of a paid plan.

Your account

To use the Service you must:

  • Be at least 13 years old (16 in the EU and UK).
  • Provide an accurate email address.
  • Keep your sign-in credentials confidential.
  • Notify us promptly at connect@mhisper.com if you suspect unauthorised account access.

You are responsible for everything that happens under your account. One account per person. Do not share or sell your account.

Acceptable use

You agree not to use the Service to:

  • Break any applicable law.
  • Infringe anyone else's intellectual property, privacy, or other rights.
  • Upload content that is illegal, harassing, threatening, hateful, sexually explicit involving minors, or that promotes violence.
  • Distribute malware, scrape the Service, reverse-engineer it (beyond what is permitted by mandatory law), bypass rate limits, or attempt to gain unauthorised access.
  • Send spam or unsolicited messages through the Service.
  • Interfere with other users' use of the Service.

We may suspend or terminate your account, with or without notice, if you breach these rules.

Your content

You own your content

You own everything you create in Mhisper — bubbles, notes, todos, zones, threads, attachments, voice transcripts. We claim no ownership.

The licence you grant us

To run the Service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit, back up, and display your content, but only for the purpose of providing the Service to you. We do not use your content for marketing, training AI models, or any other purpose without your explicit opt-in.

If a future feature involves sharing your content (e.g. collaboration, geo-social bubbles), that sharing happens only when you explicitly choose it.

Backups and exports

You can export your content as a portable memory file at any time from the app. We strongly recommend you keep your own backups of anything important.

Removal

We may remove content that we reasonably believe breaches these Terms or applicable law. Where practical we will notify you first.

Subscriptions and payments

Free and paid tiers

The Service has a free tier and one or more paid tiers. The features of each tier are described on our pricing page.

Payment provider

Paid subscriptions purchased on our website are processed by Stripe. By subscribing you agree to Stripe's terms in addition to ours.

Billing

Subscriptions renew automatically at the end of each billing period (monthly or yearly, as selected) at the then-current price. Prices are inclusive of GST where applicable.

Cancellation

You can cancel a subscription any time from Settings → Account on the website. Cancellation takes effect at the end of the current billing period. You keep paid features until then.

Refunds

We do not offer refunds, including for partial or unused billing periods. Australian Consumer Law guarantees still apply: if the Service is not of acceptable quality you may be entitled to a refund, replacement, or repair as required by law.

Price changes

We may change subscription prices. Changes take effect at the next renewal after we give you at least 30 days' notice by email.

Free trials

If we offer a free trial, the terms (length, eligibility) are stated at sign-up. You will be charged at the end of the trial unless you cancel before it ends.

Mobile apps

The Mhisper iOS and Android apps are free and do not sell digital subscriptions in-app. To subscribe you must use the website. Subscriptions purchased on the website apply to all your devices.

Our intellectual property

The Mhisper name, logo, brand, app design, source code, and underlying technology are owned by us and protected by copyright, trademark, and other laws. These Terms do not grant you any right to use them beyond what is needed to use the Service.

Beta and experimental features

We may label some features “Beta”, “Preview”, or “Experimental”. These are provided as-is — they may change, break, or be removed at any time, and our service-level commitments do not apply to them.

Third-party services

The Service relies on third-party providers (see the Privacy Policy for the current list). Their availability, terms, and policies are out of our control and not our responsibility. Outages or changes by them may affect the Service.

Disclaimers

We provide the Service with reasonable care and skill. To the maximum extent permitted by law:

  • The Service is provided “as is” and “as available”.
  • We do not warrant that it will be uninterrupted, error-free, secure against every threat, or fit for any specific purpose beyond its general description.
  • We are not a backup service. You are responsible for keeping copies of your important content.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) that cannot be lawfully excluded.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption.
  • Our total aggregate liability to you for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) AUD $100.

These limits do not apply where they cannot lawfully be excluded — including for our own gross negligence, wilful misconduct, or fraud, or for the non-excludable rights you have under Australian Consumer Law.

Indemnity

You agree to indemnify and hold harmless Mhisper, its operators, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your content, or (c) your misuse of the Service. This indemnity does not apply to claims arising from our own gross negligence or wilful misconduct.

Termination

You may stop using the Service at any time by deleting your account from Settings → Account.

We may suspend or terminate your account if:

  • You materially breach these Terms.
  • Continuing to provide the Service to you would expose us to legal or security risk.
  • We discontinue the Service (with at least 30 days' notice for paid users).

On termination we will delete your content per the Privacy Policy's retention schedule.

Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced in-app and by email at least 14 days before they take effect. The “Last updated” date at the top of this page reflects the current version. Continued use of the Service after changes take effect means you accept them. If you do not accept them, stop using the Service and cancel your subscription before they take effect.

Governing law and disputes

These Terms are governed by the laws of Australia. The courts of that jurisdiction have non-exclusive jurisdiction over any dispute arising under these Terms. Nothing in this clause limits your right, where you reside in a jurisdiction that gives you a non-waivable right to bring proceedings in your local courts, to do so.

Miscellaneous

  • Entire agreement. These Terms together with the Privacy Policy are the entire agreement between you and us about the Service.
  • No waiver. If we don't enforce a right immediately, that doesn't waive it.
  • Severability. If any clause is found unenforceable, the rest stand.
  • Assignment. You may not assign these Terms without our consent. We may assign them to an acquirer or successor.
  • Notices. We send notices to your account email. You send notices to connect@mhisper.com.
